Almtraum Berwang GmbH (with trade register number: FN 609071v), located at (6622) Berwang, Berwang 28 (hereinafter: Almtraum), is the controller responsible for the processing of data as described in this privacy statement.
Almtraum is engaged in providing services in the field of webshops and online marketing. In addition, Almtraum regularly provides supporting services to facilitate the services offered by its clients. All of this is based on, among other things, service agreements concluded by Almtraum with its clients. In order to process these agreements, it is necessary for Almtraum to process (personal) data.
The data processed may relate to products and/or companies, but it may also include information that can identify individuals. This may include name and address details, telephone numbers, email addresses, bank account numbers and similar information.
Without this information, the correct individuals cannot be linked to the corresponding assignments, meaning Almtraum would not be able to properly fulfil its contractual obligations.
Regarding marketing activities, the programs Google Analytics and Google Adwords are used. These programs also process data. This is based on Almtraum’s legitimate interest in such processing. These programs enable Almtraum to explore how (potential) customers can be approached with existing or new products.
Without the use of these programs, it would not be feasible for Almtraum to conduct market research or approach existing and new customers.
When does Almtraum obtain (personal) data
Almtraum obtains this data when a (new) relation contacts the company, whether through a quotation request or otherwise, and provides the necessary information.
Where necessary, this data will be processed by Almtraum.
Google Analytics
For marketing purposes, Almtraum uses Google Analytics and Google Ads. These tools enable Almtraum to conduct market research to a certain extent.
With Google Analytics, it is possible to obtain information such as IP addresses, which may potentially identify an individual. For this reason, such data also falls under the GDPR.
How long does Almtraum retain the data
In accordance with tax legislation, Almtraum is required to retain data related to assignments for seven years.
Personal data associated with partnerships with third parties or specific client relationships of Almtraum (contact details and correspondence history) is retained for as long as the relationship exists. After explicit termination of the relationship, the data will be deleted after 24 months.
Data that does not fall under this legal retention obligation or is not part of any partnership will be deleted or anonymised within two months of receipt so that the data can no longer be traced back to a specific individual.
Data obtained through the use of Google Analytics and/or Google Ads will be deleted no later than 50 months after receipt. Almtraum considers this period reasonable, as it is necessary to act upon the results of market research and adapt its product range and policies accordingly.
With whom does Almtraum share the data
For proper service delivery and business operations, Almtraum is required to engage third parties.
Regarding business operations
Almtraum uses the products and services of third parties. In addition to using an accounting program, an external accountant is consulted, and Almtraum regularly receives leads and assignments via third parties, during which data is shared. Internally, Almtraum uses Office 365, an ERP and CRM system, and similar programs for internal and external communication and planning.
These parties have (limited) access to the data of Almtraum’s business relations. Almtraum enters into data processing agreements with these parties to regulate the protection and use of this data.
Other third parties
Without consent of Almtraum’s relation, no data will be shared with other third parties. The only exception is when Almtraum is required to do so by law.
Storage within the EEA
The data is stored within the EU, so sharing data with countries outside the EU is not necessary. An exception applies to data stored by Google on one of their servers located outside the EU. For this, Almtraum enters into a data processing agreement with Google.
Unless Almtraum is legally required to do so, data will not be shared with (companies located in) countries outside the EU.
Data security
Almtraum ensures that organisational and technical measures are taken to secure (personal) data. For example, the hosting provider is consulted regarding the security of data received via the website, and Almtraum uses a secure firewall and antivirus software. Where possible, two-factor authentication is used to further secure account access.
Third-party websites
This privacy statement does not apply to websites of third parties that are linked to Almtraum (or otherwise connected). Almtraum cannot guarantee that these parties handle (personal) data in the desired manner. It is recommended to consult the privacy statements of these third parties to understand how they process data.
Your rights regarding the processing and protection of personal data
Under the General Data Protection Regulation (GDPR), you have several rights regarding your personal data. These rights are listed below. Right of access
You have the right to access the data Almtraum holds about you.
Right to rectification, restriction and erasure
You have the right to have the data Almtraum holds about you corrected, supplemented or completely deleted.
Regarding the deletion of data, Almtraum must comply with the statutory retention obligation imposed by law. Almtraum is therefore required to retain data that falls under this obligation. All other data will be deleted – upon explicit request – from Almtraum’s systems.
You also have the right to restrict the processing of your personal data. This means that Almtraum may store your data but may no longer process it further. This may apply in several situations, for example when preparing for legal proceedings in which you may need the data. If you believe you are entitled to the right of restriction, you are requested to contact Almtraum.
Right to data portability
You have the right to receive the personal data Almtraum holds about you in a machine-readable format. You may then store this data or transfer it to your own database or the database of a third party.
Right to withdraw consent
You have the right to withdraw your consent to the processing of specific personal data. If you wish to do so, you may contact us using one of the contact methods listed above.
Complaints & the Data Protection Authority
Almtraum encourages you to get in touch if you have any complaints regarding the processing or protection of your data. You also have the right to file a complaint. You may do so using the contact details listed above.
Under privacy legislation, you also have the right to lodge a complaint with the supervisory authority, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
